A Bengaluru court issued an ex-parte interim injunction on September 19 following a petition by producer Sri Lakshmi Venkateshwara Cinemas LLP seeking interim protection.The development comes shortly before ‘The Paradise’ is scheduled to release worldwide on September 24.
Bengaluru court restricts specific online content related to ‘The Paradise’
According to Live Law News, the injunction applies specifically to the URLs and online material identified in the producer’s plaint. As reported by The Indian Express, the makers alleged that several posts and comments circulated online after the film’s official trailer was released on August 6 went beyond fair criticism and had the potential to affect the film’s commercial prospects.After examining the material placed before it, the court found a prima facie case for granting interim protection. It subsequently restrained the defendants from hosting, publishing, transmitting, reproducing or making available the identified content.The court also took note of the producer’s concerns regarding possible financial and reputational damage if the material continued to circulate immediately before the film’s theatrical release.
Court order does not restrict genuine reviews or criticism
The interim order does not amount to a blanket ban on reviews or public discussion surrounding The Paradise. The court has expressly clarified that the injunction does not extend to bona fide public reviews and genuine criticism. The restriction remains confined to the specific URLs and content identified in the proceedings. It is also an interim measure rather than a final ruling on the dispute and will remain in force until the next date of hearing, subject to further orders.The producer has also been directed to serve the defendants with copies of the plaint, supporting documents, the relevant application and the court order as part of the proceedings.
